Terms of service
Purpose
Prospectly is a business discovery and website opportunity analysis platform. It is not an email scraping service or automated bulk-messaging platform.
Responsible use
Users must review generated content, follow applicable marketing and privacy laws, honour suppression requests, and avoid misleading or harassing communication. Audit findings must not be represented as broader guarantees.
Provider data
Business records, performance measurements, and screenshots depend on third-party providers and public websites. Results may be incomplete, stale, or temporarily unavailable. Prospectly identifies the evidence source wherever practical.
Subscriptions and credits
Paid plans renew monthly through Stripe. A credit is consumed when a new eligible lead is imported. Duplicate and suppressed records are not charged. Unused monthly credits do not roll over.
Upgrades take effect when Stripe confirms payment. Downgrades and cancellations apply at the end of the current paid period unless the Billing Portal states otherwise. A short grace period may apply to a failed renewal; existing data remains readable while new searches and generation is paused after that period.
Refunds and billing disputes
Contact billing@prospectly.com.au promptly if a charge appears incorrect. Refund requests are assessed against Australian Consumer Law and the circumstances of the service failure. A change of mind or unused monthly allowance does not automatically create a refund where the service was available as described.
Suspension and acceptable use
Prospectly may pause processing to protect users, public websites or providers from abuse, excessive automation, security threats or unlawful activity. Users must not bypass limits, share credentials, probe private systems, resell provider data, or use generated drafts for deceptive or discriminatory communication.
Intellectual property and customer data
Prospectly retains rights in the application, brand and scoring methodology. Users retain their original account content and grant Prospectly the limited rights needed to host, process and return it. Public business data remains subject to its source terms and must not be treated as owned by Prospectly or the user.
No guaranteed outcomes
Prospectly helps organise research. It does not guarantee replies, meetings, sales, search ranking improvements, or business outcomes.
Account closure
Workspace owners may cancel billing through the customer portal and delete workspace data from settings. Some financial or security records may be retained where legally required.
Availability and liability
Provider outages, public-site changes and maintenance can interrupt searches or audits. Prospectly will take reasonable care but cannot promise uninterrupted availability. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
